What is the role of community leaders in resolving encroachment disputes? A new report by the government’s Joint Council on Dissemination and Assessment, showing how local Indigenous communities in Queensland respond to the demands of the courts, community groups and law-enforcement agencies to resolve disputes over land, property rights, and other socio-environmental issues. The report also considers that legislation affecting lands and resources is widely accepted in this framework. It argues that the law is sufficiently broad that one may determine what to do if an area is currently considered a minefield. A variety of law and legal models have been used in different ways by Indigenous groups at various stages of the process. For instance an appeals court and a judge’s panel have used the laws and “rights” of Indigenous communities in the process. The British Justice Committee’s study on land disputes, particularly in the early 1990s, shows a substantial change in how courts and/or the governing bodies are dealt with with this scenario. This analysis presents evidence that Aboriginal communities across Australia respond – often to the law and the regulations of government – towards disputes of their own or of other communities as they have been raised in courts and justice systems in recent – and that individual groups – private and public (where appropriate) – are ultimately free to challenge their government’s decisions.
